Terms and Conditions of Sale and Use

Service overview

MatsevaLink enables the creation of personalized commemorative plaques equipped with a QR code that provides access to a digital page dedicated to the memory of a deceased loved one.

Pages may include, in particular:

  • photographs;
  • a biography;
  • prayers;
  • psalms;
  • tributes;
  • memories shared by the family.

Use of the site and any order imply acceptance of these terms.

Orders

Every order implies acceptance of these terms.

The customer warrants that they:

  • are of legal age and legally competent;
  • provide accurate information;
  • hold the necessary rights to the content submitted;
  • act with the consent of the persons concerned where required.

An order becomes final once payment has been validated.

Customization

Each plaque is made to order.

The customer is responsible for verifying:

  • names;
  • dates;
  • photographs;
  • texts;
  • translations;
  • all information submitted.

Once production has begun, no changes can be guaranteed.

Any error arising from information provided by the customer remains the customer's responsibility.

Payment

Payment is due at the time of order.

An order is considered confirmed only after payment has been effectively confirmed.

Payments are processed through secure payment providers.

MatsevaLink never stores customers' full banking details.

Production and delivery

Production and shipping times are provided for guidance only.

Plaque delivery is available within Israel only.

Orders are generally delivered within up to 12 business days after the order is confirmed.

Delays may be extended in particular due to:

  • holiday periods;
  • customs formalities;
  • carrier delays;
  • events beyond our control.

MatsevaLink cannot be held liable for delays attributable to carriers, postal services, or customs authorities.

Receipt of order

The customer is asked to inspect the condition of the package upon receipt.

Any claim regarding a visible defect or transport-related damage must be reported within a reasonable time after receipt.

Plaque installation

The customer alone is responsible for installing the plaque on the grave or memorial.

It is the customer's responsibility to verify applicable rules in advance with:

  • the cemetery;
  • the Hevra Kadisha;
  • the municipality;
  • or any other competent authority.

MatsevaLink does not guarantee that installation will be permitted in all cemeteries or places of remembrance.

Durability and maintenance

Plaques are designed for outdoor use.

However, their lifespan may be affected by:

  • weather conditions;
  • sun exposure;
  • humidity;
  • cleaning products;
  • acts of vandalism;
  • natural wear.

No specific lifespan can be guaranteed.

Theft, damage, or loss

After delivery, MatsevaLink cannot be held liable for:

  • loss;
  • theft;
  • vandalism;
  • damage;
  • disappearance;
  • removal of the plaque by a third party.

Any replacement request may be subject to a new order.

Custom products

Because plaques are made to order and personalized, they cannot be returned, exchanged, or refunded after the order is confirmed, except where an error is directly attributable to MatsevaLink.

QR code and digital technologies

The QR code provides access to a digital page hosted by MatsevaLink.

The customer acknowledges that digital technologies, mobile devices, and computing standards evolve over time.

MatsevaLink undertakes to maintain the service under reasonable conditions but cannot guarantee absolute compatibility with all existing or future devices.

Published content

The customer remains solely responsible for submitted content, including:

  • photographs;
  • videos;
  • biographies;
  • tributes;
  • religious texts;
  • translations;
  • testimonials;
  • memories.

The customer warrants that they hold all necessary permissions.

Image rights

The customer certifies that they have obtained all necessary permissions regarding photographs, videos, and published content.

The customer agrees to indemnify MatsevaLink in the event of a third-party claim relating to submitted content.

Prohibited content

The following content is prohibited:

  • illegal content;
  • defamatory content;
  • abusive content;
  • hateful content;
  • discriminatory content;
  • content contrary to public order;
  • content that infringes the rights of others.

MatsevaLink reserves the right to remove or suspend any content that does not comply with these rules.

Prayers and religious content

Religious texts offered on MatsevaLink are provided for informational purposes only.

Because customs may vary according to communities, traditions, or rabbinical authorities, MatsevaLink provides no religious, halakhic, or spiritual advice.

Hosting of commemorative pages

We make every effort to ensure service availability.

However, temporary interruptions may occur for reasons including:

  • maintenance;
  • security;
  • updates;
  • technical incidents;
  • failure of a third-party provider.

Permanent availability cannot be guaranteed.

Service duration

Unless otherwise stated at the time of purchase, MatsevaLink undertakes to maintain the commemorative page associated with the QR code for a minimum period of ten (10) years from its creation.

Data backup

The customer is advised to keep a personal copy of submitted content.

Although backup measures are in place, MatsevaLink cannot guarantee the complete absence of data loss resulting in particular from:

  • a major outage;
  • a cyberattack;
  • force majeure;
  • unforeseeable technical failure.

Data protection

Information collected is used exclusively for:

  • processing orders;
  • managing commemorative pages;
  • customer support;
  • improving the service.

Data is never sold to third parties.

The customer may request access to, correction of, or deletion of their personal data within the limits provided by applicable law.

Cookies

The site may use cookies in order to:

  • ensure proper operation;
  • improve the user experience;
  • measure audience;
  • analyze site performance.

Limitation of liability

Within the limits permitted by applicable law, MatsevaLink's total liability shall not exceed the amount paid for the order in question.

MatsevaLink cannot be held liable for:

  • indirect damages;
  • data loss;
  • financial loss;
  • loss of opportunity;
  • moral harm;
  • consequences related to information provided by the customer.

Force majeure

MatsevaLink cannot be held liable for any delay or failure to perform resulting in particular from:

  • a natural disaster;
  • war;
  • a pandemic;
  • a cyberattack;
  • a strike;
  • a major outage;
  • an administrative decision.

Changes to these terms

MatsevaLink may modify these terms at any time.

The version in effect is the one published on the site at the time of use of the service or placement of an order.

Governing law

These terms are governed by the laws of the State of Israel.

Any dispute relating to the site, the service, or an order shall be submitted to the competent courts of Israel.
